LIMITED WARRANTY

NUVICO warrants our products, purchased on or after the effective date, in material and workmanship for three (3) years from the shipment of the product by NUVICO to an Authorized Distributor. Exceptions to this period are: PTZ DOMES for two (2) year from the date of shipment and PTZ Zoom modules ninety (90) days from the date of shipment.


NUVICO will (at their sole discretion) repair or replace, without charge, any product determined to be defective in material or workmanship during normal use and service under the terms of this warranty.
The repaired or replaced product is warranted, pro-rated, for the balance of the term of the original warranty.


NUVICO will only knowingly sell it's products wholesale, through Authorized Distributors to ensure that our customers obtain proper support and service. In the event a NUVICO product is purchased from any unauthorized source, the NUVICO Warranty Policy is null and void with respect to that product.

 

WARRANTY EXCLUSIONS

  • Damage resulting from use with incompatible products.
  • Damage caused by accident, abuse, misuse, flood, fire, earthquake, lightning, power surges or other external causes.
  • Damage caused by operating the product outside the permitted or intended uses as described by NUVICO.
  • Damage resulting from service (including upgrades and expansions) performed by anyone not previously authorized by NUVICO.
  • Any product or part that has been modified without prior, written permission of NUVICO.
  • Any consumable parts, such as batteries.
  • Any product in which the serial number has been removed, tampered with or defaced.

NUVICO assumes no risk and shall be subject to no liability for any damages or loss resulting from any specific use or application made of it's products. NUVICO's liability for any claim relating to it's products and/or practices shall not exceed the price paid by the customer and received by NUVICO for said products. In no event will NUVICO be liable for any special, incidental or consequential damages (including loss of use, loss of profit or any third-party claims), whether by error, omission or negligence on the part of NUVICO or it's employees.

 

ADVANCE REPLACEMENT POLICY

NUVICO will provide a replacement unit for any product assumed to be defective up to 90 days from shipment of the product by NUVICO to an Authorized Distributor, unless the Distributor provides serial # tracking on all sales invoices for Nuvico product. Whereupon the 90 day policy will extend to the date product is sold to the installing contractor. Upon determination by the Distributor that a unit is "bad out of the box" or fails subsequent to initial installation, the Distributor must request authorization from an appropriate NUVICO representative for an "Advance Replacement". Upon receipt of said authorization, the Distributor can then choose to replace the unit directly to the customer from their existing stock or request a unit be shipped at no charge via standard freight from Nuvico. In either case, an RMA # must be obtained from Nuvico Customer Service Department prior to sending the defective unit back to Nuvico for evaluation.

Advance replacement products are new or "like-new" refurbished products and are warranted as new.

Advance replacement items will be invoiced upon shipment by NUVICO and subsequently credited to the Authorized Distributor upon receipt by NUVICO of the presumed defective product.

Invoices will remain "due and payable" if the returned product is determined by NUVICO to not qualify under the advance replacement or warranty terms.

 

EXCLUSIVE REMEDY

NUVICO MAKES NO OTHER EXPRESS WARRANTY, WHETHER WRITTEN OR ORAL, AND NUVICO EXPRESSLY DISCLAIMS ALL WARRANTIES NOT STATED IN THIS LIMITED WARRANTY. ANY IMPLIED WARRANTY OR CONDITION OF MERCHANTABILITY, SATISFACTORY QUALITY, OR FITNESS FOR A PARTICULAR PURPOSE IS LIMITED TO THE DURATION OF THE EXPRESS LIMITED WARRANTY SET FORTH ABOVE AS PERMITTED BY LOCAL LAW.

THE LIMITED WARRANTY TERMS ABOVE, EXCEPT TO THE EXTENT LAWFULLY PERMITTED, DO NOT EXCLUDE, RESTRICT OR MODIFY, BUT ARE IN ADDITION TO THE MANDATORY STATUTORY RIGHTS APPLICABLE TO THE SALE OF THIS PRODUCT TO THE CUSTOMER.

 

 

Return Procedures

 

A. Return Merchandise Authorization ("RMA") for Product Returns

If a repair is required, the Distributor must request and obtain a RMA number through fax or e-mail. All returns must be accompanied with the assigned RMA number via prepaid freight. The RMA number is valid for 30 days from issuance and a new one will need to be requested in the event it expires.

NUVICO will not accept any unauthorized or "freight collect" returns. Nuvico will return any shipment to the shipper at shippers expense, should only a portion of it have an appropriate RMA. In the event a returned product contains parts that are no longer available or practical to repair, NUVICO will contact the customer to discuss a mutually equitable resolution.

B. Returns for Credit or Product Restocking

A restocking charge of twenty percent (20%) of the original purchase price will be applied to all approved credit returns of products returned for reasons other than product failure, unless prior written authorization is secured through NUVICO.
1. Product must be new, in resellable condition with all original packaging, manuals and included accessories.
2. Stand-alone accessories and mounts are excluded from both Credit and Restock programs.
3. Product must be returned within 120 days of original invoice date.
4. Credit will not be issued for shop worn, previously installed products or damaged merchandise.
5. Credit must be used within one (1) year of the date of issue or will be forfeited.

C. Return Procedure for Repair or Restocking

The following procedure must be strictly followed by the customer in order to return the products for any reason. Otherwise, the items will be returned to the customer at their expense.

1. Contact NUVICO by telephone, fax or e-mail.

2. Provide us with following information:

* The quantities of the products to be returned.
* The model number and serial number of the product(s). If no serial number is available, the product(s) will be considered a non-warranty repair.
* The reason for the return and brief description of the symptoms, problems or NONE, for restock purpose.
* Contact information for follow-up.

3. NUVICO will then issue a RMA number. For Non-Warranty Repair; NUVICO will provide in writing, an estimated cost for the repair based on minimum labor charge of $75, plus any additional part(s) cost, which the customer agrees to pay when accepting the RMA. Please refer to Non-Warranty Repair section for further details.

4. Return the product(s) with the RMA sheet included and clearly marked on the box. Any package return to NUVICO without a RMA number will be refused and sent back to the shipper at shipper's expense.

D. Packaging

Protecting the value of returned products by packaging and shipping them correctly is sender's responsibility. We reserve the right to deny warranty coverage for any damage caused by improper packaging

E. Upon Receipt of the Product by NUVICO

We will evaluate the product and either:

1. Repair or Replace any product(s) covered by the warranty and return the products(s) back to the customer.

2. If the product is determined not to be covered by warranty, NUVICO will inform the customer with reason(s). We will also provide estimated repair costs. (See charges for Non-warranty Repair Section)

3. At NUVICO's sole discretion, we will issue credit to the customer instead of repairing or replacing the products when we determine that repair or replace is not an option.

4. Upon evaluation, we will credit the customer for pre-approved restock return or advanced replacement item.
5. Credit the Product sent for stock rotation or otherwise under these terms:
* The amount of the credit will not exceed the price paid by the customer at the time of purchase adjusted according to the conditions set below.
* For products returned for credit only (no Advanced Replacement DOA), the credit will be reduced by the 20% restocking fee plus refurbishing fee, if applicable.
* For out of stock or discontinued products instead of repairing or replacing at NUVICO's sole discretion.
* No credit will be issued for items that are not received by NUVICO within 30 days of the RMA date.

F. Charges for Non-Warranty Repair

1. All non-warranty Products repaired by NUVICO will be charged a minimum $75 for evaluation for an initial hour, parts cost, plus any shipping and handling charges. The labor cost will be calculated at $75 per hour after the initial hour of evaluation which will be added to the repair cost. We will inform Customer of the repair charges prior to the repair.
2. With the customer's written confirmation, NUVICO will proceed with the repairs, and the customer will be billed the repair charges, plus all shipping and handling charges.
3. In the event the Customer does not want NUVICO to proceed with the repairs, the Product will be returned to the Customer un-repaired, and the Customer will be billed a $75.00 for evaluation, plus any shipping and handling charges.
4. The warranty for the repaired product is only for the repaired parts and labor, and ninety (90) days from date of shipment from NUVICO.

 

Product Diagnosis Service

Upon special request by the customer, NUVICO will diagnose the product for any possible defects. A minimum of $75 will be applied to individual product. Whether the product is in-warranty or out of warranty, this charge will be applied for the labor that is involved.
